Agreement to Terms

By accessing and using MarkTrack ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, you may not access the Service.

Description of Service

MarkTrack provides a cloud-based Student Information System designed for religious schools, maktabs, Sunday schools, and madrasahs. Our Service includes attendance tracking, gradebook management, parent communication tools, and related educational management features.

User Accounts

To use MarkTrack, you must create an account. You agree to:

• Provide accurate and complete information during registration
• Maintain the security of your account credentials
• Promptly notify us of any unauthorized use of your account
• Be responsible for all activities that occur under your account

Acceptable Use

You agree not to:

• Use the Service for any illegal purpose or in violation of any laws
• Attempt to gain unauthorized access to our systems or networks
• Interfere with or disrupt the Service or servers
• Upload viruses, malware, or other harmful code
• Violate the privacy rights of students, parents, or other users
• Share your account credentials with unauthorized persons

Subscription and Payment

MarkTrack operates on a subscription basis:

• Subscription fees are charged monthly based on the number of active students
• You are responsible for all charges incurred under your account
• We offer a free trial period with no payment required
• You may cancel your subscription at any time
• No refunds are provided for partial months of service

Data Ownership and Rights

You retain all rights to your data, including student records, grades, and other information stored in MarkTrack. We do not claim ownership of your content. You grant us a limited license to store, process, and display your data solely for the purpose of providing the Service to you.

Service Availability

While we strive to provide uninterrupted service, we do not guarantee that MarkTrack will be available at all times. We may experience downtime for maintenance, updates, or due to circumstances beyond our control. We are not liable for any losses resulting from service interruptions.

Termination

Either party may terminate this agreement:

• You may cancel your subscription at any time through your account settings
• We may suspend or terminate your account if you violate these Terms
• Upon termination, you will have 30 days to export your data
• We will delete your data after the export period unless required by law to retain it

Limitation of Liability

To the maximum extent permitted by law, MarkTrack shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including lost profits, data loss, or business interruption arising from your use of the Service.

Indemnification

You agree to indemnify and hold harmless MarkTrack from any claims, losses, damages, or expenses (including legal fees) arising from your use of the Service, violation of these Terms, or violation of any rights of another party.

Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of material changes via email or through the Service. Your continued use of MarkTrack after changes constitutes acceptance of the modified Terms.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to its conflict of law provisions.
